Terms of Service

Last updated: September 10, 2026

These Terms of Service ("Terms") govern your access to and use of hilltopperbikes.com, related online services, and purchases from Hilltopper Electric Bike Company ("Hilltopper," "we," "us," or "our"). By using the website or placing an order, you agree to these Terms and to the policies incorporated into them, including our Refund, Shipping, Privacy, and Warranty Policies.

1. Eligibility and Acceptable Use
You may use the website only for lawful purposes. You may not misuse the website, attempt unauthorized access, interfere with site security or operation, use automated systems in a way that places unreasonable load on the service, or use our content or services to violate applicable law or the rights of others.

2. Product Information and Compatibility
We make reasonable efforts to describe products accurately. Product specifications, colors, packaging, features, dimensions, availability, and compatibility information may change. Electric-bike conversion kits depend on bicycle condition, dimensions, components, installation quality, intended use, and local regulations. You are responsible for confirming that a product is appropriate for your bicycle, riding conditions, intended use, and jurisdiction before installation or operation.

3. Orders and Acceptance
Submitting an order does not guarantee acceptance. We may cancel or limit an order for reasons including inventory errors, pricing errors, suspected fraud, payment issues, shipping restrictions, regulatory restrictions, or inability to fulfill the order. If we cancel an order after payment is captured, we will provide an appropriate refund.

4. Prices and Payment
Prices are shown in the currency indicated on the website and may change without notice. Taxes, shipping, duties, fees, and other charges may apply depending on the order and destination. You authorize us and our payment providers to charge the payment method you submit for amounts properly due for your order.

5. Shipping, Returns, and Refunds
Shipping estimates and return rights are governed by our Shipping Policy and Refund Policy. Those policies are incorporated into these Terms.

6. Warranty
Product warranty coverage is governed by our Warranty Policy. Except for express warranties stated in writing and rights that cannot be excluded by law, products and services are provided on an "as available" basis to the maximum extent permitted by law.

7. Installation, Maintenance, and Safety
Electric bicycle systems involve electrical, mechanical, battery, braking, and drivetrain components. Improper installation, maintenance, charging, or use can result in property damage, injury, fire, or other hazards. Follow all product instructions and safety information. If you are not qualified to perform installation or service, use a competent bicycle or electric-bicycle technician.

Do not use damaged batteries, chargers, wiring, connectors, or structural bicycle components. Stop using a product and seek assistance if you observe overheating, swelling, smoke, unusual odor, damaged wiring, braking problems, wheel instability, or other unsafe conditions.

8. Laws and Riding Regulations
Electric bicycle definitions, speed limits, power limits, equipment rules, trail access, registration requirements, helmet rules, and other regulations vary by location. You are responsible for knowing and complying with laws and rules applicable where you install and use the product.

9. Intellectual Property
The website and its original text, graphics, logos, photographs, videos, product names, documentation, and other content are owned by or licensed to Hilltopper and are protected by applicable intellectual-property laws. You may use website content for ordinary personal shopping and product-support purposes, but you may not reproduce, distribute, modify, exploit, or falsely claim ownership of our content without authorization.

10. Third-Party Services and Links
The website may use or link to services operated by third parties, including Shopify, payment providers, carriers, social platforms, analytics providers, and other service providers. We are not responsible for third-party services outside our control, and your use of them may be governed by their own terms and privacy policies.

11. Limitation of Liability
To the maximum extent permitted by law, Hilltopper will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or products. Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability or consumer rights that cannot legally be limited.

12. Indemnification
To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful misuse of the website, intentional violation of these Terms, or unauthorized modification or use of products in a manner contrary to applicable instructions or law.

13. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the website with a revised "Last updated" date. Changes apply prospectively unless applicable law requires otherwise.

14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law.

15. Contact
